The Dutch gun laws are again modified (effective: July-1st-2014) with some very drastic consequences.
A. Handling/using/owing any type/kind of (potential) weapon is forbidden! For instance if one does want to own (or already owns) a gun one does need a permit, but is no longer a privilege and the permit can be revoked (guns confiscated) without any kind of particular reason. In effect the Dutch government now can ban all guns instantly when ever they like.
B. Producing/owning/repairing guns and more importantly owning any “gun parts” is illegal without a special permit. All spare parts must be registered and must fit your gun(s) that are mentioned on your permit. This includes ammo and all reloading components, ammo (components) that are not registered on your permit are illegal and lead to a revoked permit and confiscation. So for instance if you have .500S&W case displayed on a shelf just for fun but you don’t actually own a registered .500S&W gun is reason enough to get your guns confiscated.
C. A gun/hunting licence can be instantly revoked (guns confiscated) when a family member, relative, a neighbour or your neighbourhood is engaged in criminal activities. Including (potential) local or national civil unrest and/or other known or yet unknown (potential) risk factors (this definition is not specified!). Or the fear for misuse of a weapon, this can be determined by nearly every member in service at the Justice department (on the payroll of the government) without professional knowledge and/or education regarding gun laws or medical degree.
D. Self-defence with a gun (or any other kind of weapon) is illegal (now for ever) no matter the circumstances/situation. This was always illegal but in some highly exceptional circumstances it was accepted, now it’s illegal no matter what. Punishable with a mandatory jail time of minimal 3 years even if your personal (or loved ones) live depends on the self-defence. This jail time will be extended if someone gets injured or dies.
E. Your licence can be revoked in case of a “any kind” of criminal offence, usage of prescription medication (no matter the medication), any kind of psychiatric condition (or hospitalisation). A criminal conviction includes: jail-time, a fine or even just a court hearing as a perpetrator or as whiteness. In essence if one has come in contact with the justice department it can lead to a revoked licence, even if you are proven innocent. The fact alone you have came in contact is reason enough. This might include relatives and family members that have to been in contact with the Justice department (court), no matter the relationship or distance. For instance: If a member of the public has made an (even fake) accusation towards you, you are under investigation and therefor your permit is instantly revoked! Or at least your guns are “temporary confiscated” for fear of misuse (see C).
F. A (potential) bad “social support system” can lead to confiscation of (any) weapon. Meaning if you are at the low(est) end of the social ladder you are deemed as a danger to own guns, knives, bows and so on. This is extremely discriminating!
G. The definition of “shooting sport” & “hunting”. The government has now determined what is considered to be shooting sport & hunting in great detail. The Dutch Shooting Sport Association has set up these guidelines including the UIT, ESC, ISSF, Olympic rules. Any gun that not fit these rules is now illegal to own. Thankfully the ISSF has a broad range of shooting disciplines.
H. Gun clubs and/or ranges are no longer allowed to exploit commercial activities except to provide their members/visitors with the bare minimum: Like beverages and a few snacks. No gun sales, no ammo sales, no activities to support a party (like a BBQ), no promotional activities. Many gun ranges will close due to loss of income.
I. New (future) gun owners now (since July 1st 2014) can only use/shoot/own guns that are conform Olympic rules and regulations. Guns that are “not used” in Olympic disciplines no longer can be purchased by new/future gun owners. For current gun owners there is a “temporary exception” and is subject of change at will of the Government. Meaning: gun ownership will die out.
J. The mandatory “unannounced” house calls. The local police can now enter your house without your personal presence. If someone is at home (even a 5 year old kid) they are allowed to enter, no questions asked. If no one is present the police can enter the house with just a phone call to the local DA to obtain permission, just to conduct the yearly check. No other reason is needed. But the Justice department “ recommends” that you are present to conduct an objective house call. The officers (minimal 2) that do the house call can make a judgement them self if you have done something wrong. These are regular foot/patrol officers that have no particular training and knowledge. It’s up to their judgement if you still have your guns after they left......that’s a downright dangerous situation. Note: The new law prohibits you from going to court to get your guns back.
A couple months ago we (the gun owners) have won a case at the supreme court, but the government just chanced the law. The new law is so tight and so well reformulated that not even the European and International Court can turn it back.
This law passed (in a closed siting) parliament during the summer holidays when nearly no one was there to intervene or to object. Looks like we are screwed again......
I did not even mentioned the new laws regarding owning explosive components that passed parliament 2 hours after the gun law. This can result in a ban on reloading in the future but has not yet approved by the EU.
