Hacker, t came out the right way, but it is still subject to review by an extended panel of the 9th circuit. With any kind of luck, it may set up a conflict between the circuits that precipitates review by SCOTUS. All in good time...

Pooh, I was under the impression that it was the full panel that wrote that decision, now I'm going to have to find out.

Well the 9ths track record when their rulings have gone before the SCOTUS have been over turned %90+ of the time. Question here is how Roberts will decide.

Pooh , thanks (I think) I was lead to think it was a full court however it seems ,at least for now, the a.g. (Intentional) has backed of. We'll see though.

I don't do Federal practice, but I believe that the losing party would have to file for a review by a full panel. I don't know how they have to make that election, but thirty days would be my guess. Review by the Supremes would require a petition for a writ of certiorari, and ultimately, four of the nine justices would have to vote to hear it. That's more likely if there's a conflict between two circuits or it appears an issue is in need of resolution. Roberts ? My fifteen year old Subaru is more reliable !

It will be interesting to see how this shakes down. President Trump has had an opportunity to water down the 9th Circuit to such an extent that it may at least be upraded to a crap shoot ! the 9th has 29 judges, and eleven of those sit in an banc session. I don't know how they're picked for that. (Reminder, in 40 years of practice, I've actually appeared in Federal Court less than ten times-all of those were in bankruptcy issues arising out of foreclosures I was doing.) It will be interesting to see how this settles.
